Can airlines be expected to penalise their own customers for this?

It is a crime... and it is punishable by up to $10,000 and/or jail time I believe... Don't do it... the fire hazard alone is enough to make you not want to do it... yes, smoking will kill you anyway... but fire and airplanes do not mix... the fact is, people have no means of evacuation, with the exception of the pilots diving to the nearest airport, which, in many cases may not be possible in an acceptable amount of time...

Seldom, but it is a federal crime and if you do it you can expect to be arrested by federal officers on landing.

Since it is a federal crime it does not require the airline to press charges. If I caught you smoking on a plane with me I'd sure as hell report you to the air crew and make sure the TSA knew what you had done if the airline didn't handle it themselves. I'd take pleasure in appearing as a witness in your court case.

At least one aircraft has been lost due to idiot smokers stuffing their cancer sticks in the bathroom trash.

This is now law, and yes they will prosecute you. If there are 120 seats on the plane they aren't worried about you, there are plenty of nonsmokers who will take you place. If you want to smoke, stay off planes.pp
