If he made over $3400 gross income for 2007, then you can't claim him. If he didn't, AND he lived with you ALL year, AND you provided over half of his support for the year, AND your relationship doesn't violate any local laws or ordinances, then you most likely can claim him as a dependent. That wouldn't entitle you to file as head of household though.
