Because, under the law, they are NOT scalping. Nearly every jurisdiction specifically allows for licensed ticket brokers. Stub Hub and similar agencies are covered by those laws. Some of the fraudulent sites ARE shut down when the authorities find them.

Because the aren't doing anything illegal, it's the people putting their tickets on the sites that are doing something illegal. Like limewire. You don't have to use if for illegal purposes, they even show you how not to, but it's your choice to do it or not. So, it's the people getting arrested.
