and i pay taxes. I have a baby on the way and im getting married. Ok its time to become legal. Whats the best way? Should i go back home and do it from there or is there a way to do it here? I really need so solid advice. I want to be successful for myself and my family. When i came here i was a dumb child now im a man and want to make things right. Thank you

Here you go, accurate, solid advice.....
You can't do it without going back to El Salvador. I've posted this answer 1,000 times and it's as accurate today as the first time I posted it.
Your American spouse should file a petition for you with the Citizenship and Immigration Service. Use Forms I-130 and G-325.
Where it asks about your arrival in the United States write "uninspected." You will be notified to return to El Salvador and do your interview at the US embassy there.
After your interview it's almost certain you'll be rejected and banned from the United States for 10 years. Don't worry, this isn't the end of the process.
After being rejected and banned your American spouse will file Form I-601 (Application for Waiver of Ground of Inadmissibility) with the Citizenship and Immigration Service.
Given your status as married to an American citizen and an American born child there's an excellent chance the waiver will be approved and you'll be granted a visa to come back LEGALLY and get a green card to say here LEGALLY and eventually become an American citizen.
The one thing that could trip you up is if you've been arrested and/or convicted for any crimes while illegally in the United States.
The fact that you can prove you're paying taxes to the IRS and state government is also in your favor.
I highly recommend that your wife use an experienced immigration attorney for the waiver request.

First of all, you need to check whether your parents got you citizenship if you came here as a child. You are in one of the groups that I believe should have amnesty, as long as you dont commit major crimes. Also be VERY careful to not commit any crimes, many that are misdemeaners for americans are felonies for immigrants (legal or not) and WILL get you deported.
Get an immigration lawyer, apply for a marriage visa/green card NOW. Carry this paper with you at all times. unfortunately if you go back home it can take several years to successfully apply/ pay for valid emmigree status/visas. Also getting caught by LA migra/ ICE now carries up to a year jail time, automatic deportation, and forbidance of reentry for 5-10 yrs!!!! Get people to write letters of recommendation, and from your boss/coworkers too, for your applications. Sometimes these help. Good luck, and whatever happens, be a good dad to your baby that's who matters. Make a plan w/ your wife if you do get caught and deported, so that hopefully she and baby can relocate back w/ you, maybe plan to move to MX while waiting for legal papers/visas.

I do know that if you have a SS number (since you are paying taxes you must) you should be able to get married in most states. Then you can deal with the immigration issue.
I have a friend that married someone in the exact situation you are faced with. They did have to hire an immigration lawyer (about $800) but he was able to get legal. The lawyer told them that it was good they were having a baby at the time.

The ability to procreate does NOT make you a man. However, if you are sincere you take your family back to El Salvador and start the process legally. If your wife is legal then you can do things a bit quicker but it starts with you leaving the nation. If you mess around and get deported it will be ten years before you can come back legally.
I will probably regret giving you the benefit of the doubt but that's it. You can screw yourself up or take responsibility. Your choice

In many countries you can get temporary visas without any trouble at all. You simply pay a small fee, and in the US you can do it online, I would do that immediately, have them send your visa to a PO Box.
Afterwards, you can make an permanent visa application.
You may use the internet to determine what the proper method of immigration is from the perspective of workers applying for permanent visas.
However, the INS is not a well functioning entity so you may not be well positioned to do this "officially".
You can and should get yourself to school, the more education you have the better opportunity you have to have favorable treatment of your visa application, an actual citizen in the family makes it that much easier.
If you leave, you may not be able to get back so look for states offering amnesty efforts.
My recommendation would be to make a visa application through family in San Salvador once you figure out how that application process should occur.
You may also choose to contact your Embassy either in Washington or the Salvadoran mission at the UN, ask them what can be done regarding making a visa application without compromising your family's situation in the US.
Having said that, speaking plainly, if it were me, I would approach your wife, you may need to return to El Salvador and then approach the Embassy there yourself (not unlike what I suggest above).

Well,first thing i'd worry about is,if you do have to leave and come back,you'll get caught by American Airport immigration. They'll see that you've over-stayed the 90 days,and you may have trouble getting back in,as they won't trust you.
Though,once you're married,you will have to go back to your home country and apply for a Spouse Visa,which will then allow you to come back into America to live and work legally.
That's the easiest way i know of (i'm British and have an American fiance,and after we marry,thats the route we're taking for me to be able to live in the States with him).

jhsm has some good factors. additionally, your female buddy desires to be attentive to that the main intense factor the consul that does her interview will seek for is evidence that she has reason to return to El Salvador. A company, college, infants or different sturdy family contributors ties which will assure him she intends to return back is the main important standards to be granted a centred visitor visa.

I respect your honesty, Go home and come in through legal channels, do this before your baby is born, we have enough anchor babies already.
If you are working and paying taxes, and you are an illegal, then you and your employer have broken the laws of my Country, and we have to wonder what kind of citizen you would be, as you started your life here as a criminal, working for a criminal!!!
If you leave on your own we may see this as an act of atonement that would help you greatly to redeem yourself in the eyes of the law and the people of the US!!!

well i hate illegals that come here and then apply for legal status that just pisses me off because you take jobs from hard working american citizens and your kind of behavior should not be allowed but i would really respect you if you went back to el salvador and filed for american citizenship legally you see thats what you should have done in the first place.
