What happened to me was not only stupid it was very unfair and there is nothing I can do about it without dragging it out further. It's expired now so I don't feel threatened to talk about it. Happened 5 years ago.
There was this 16 year old mentally challenged kid who used to stand in front of my house, on the sidewalk and shout obscenities at my house (yes my house, no one was outside) because according to him "AMERICA IS A COMMUNIST" he woudl swear and when I would go outside and ask hiim to leave, he woudl stand on the sidewalk and tell me it was public property and he could stand there all day. So I would call the cops and he would run when they saw him. The police spoke to the parents but it did not good. He kept coming back. The police suggested I get a restraining order so I did. I had to show up in county court which is a hours drive away. The restraining order was granted.

Next thing I know,. I am served with papers. His mother, on his behalf, is asking for a restraining order on ME!.
For what? For telling the kid to get off my property? This kid, btw, was also convicted of stealing from my property.
We go to court and the judge was more interested in the beauty of this punks blonde cutie pie mother than he was of the facts and he ordered the restraining order. I said outloud, "YOU HAVE GOT TO BE KIDDING ME!" and walked out of the court room. I was followed by the bailiff who warned me that I could be held for contempt of court. I said "well I do have contempt, that was not fair, I did NOTHING except tell that kid to leave my property." the bailiff said "I know but that is the way it goes."
It still pisses me off 5 years later.
have you ever had this kind of thing happen to you? the damn thing is on my record now. I am such a criminal,I have a speeding ticket and a restraining order.
BTW this kid threatened to kill his mother & is incarcerated

I didn't appeal it because we only have one judge. Not to mention the cost and time involved. The judge is a jerk, he must have been a crappy lawyer too because he drives a beater car. Or maybe he gets his tires slashed alot and keeps his good car at home. LOL!

I had a situation where a parent wa hurt pretty bad in a hospital. We were pretty well set up as the out of town attorney backed out at the last minute (as knew coud not win). Then the local yocal waited till the last minute and droped out. I think got another attorney, who two days before said he had to go to the Mayo CLinic in minn or be cripled for life. Checking with them he was not admitted and the lady said they were so backed up it would take 3 months to get in. i went and the attorney for the other side got up in the creeps chambers and lied. Then I spoke and instead of saying the attorney knew the facts and that there was doumentation and he was a liar and piece of a wood chip I just brought out the facts on how they had coveredit up and lied about it. The judge, lady typing and attorney freaked out. Anyway the judge then told the lady to hand him the two pieces of paper she had in front of her when we went in and they had already been filled out to run against.
This medical facility has River in it's first name and where I live all the Black, White and american Indian folks callit "Killer" as so many go up for simple stuff and don't come back. So he threw the case out.
I still havf the Feds and will pursue RICO violations as six other people have been hurt. After they dropped my parent off this deal onto the concrete floor they just put them in a bed and then shipped them out, but did charge $15,000 for tests to cover their a*****. The only reason this happened is that it was owned by a corp out of texas and there just happened to be a head honcho who came throgh and talked with my parent.. I wanted to ask this person if he had the tests done to CTAs or was he concerned, but will carry the torch.
I would never think you of all people would attack a defenseless handicapped person, just shows how you can have a diffferent understanding of a person. Did you join the communist party? did you throw things at the child? Did you bribe him to try and knock his Mom off? Maybe you should send her a card and tell her youknow how she feels and hope he gets out soon! Naw. Take care.
Why did he go to your house, comrade. YOu could have the local prayer group g to bat for him that he gets out soon and tell 'blondy" that. Any info on how he tried or why he tried to knock his Mom off? Also the judge that granted your restraining order, was that the same one?
Since the order has exspired don't you think you should go to the jail and see the kid? they have the wire mesh fence, so you and he could talk and take a stick. take care. It's alovely ****** war. Bravo Charlie out. i hope you know i am kidding, but the others might not, so everyone I am kidding, but the stick thing is funny. Payback is H***!

Wow that does sound unfair. I've never had a restraining order against me. I would advise trying not to think about it if you can. It will only bring stress onto yourself.
In high school I broke up with a boy who came to my house and theatened to have some one use a blow torch on me. Thank goodness I didn't see any blow torches or otherwise, but I lived in fear for a while.
I made a police report and asked if they could make an injunction against him. They wouldn't do it.

When I was 17 years old I worked at McDonald's (kinda funny because now I draw security systems for McDonald's). There was a girl I worked with whom disliked me because I was FRIENDS with a boy whom she liked alot and she was jealous. She went to her parents and told them that I threatened to KILL her in which I never even spoke to her ever! So I was arrested and they had a restraining order put on me for it until the court date when they dropped the whole thing! My mom had to pay for a lawyer to do nothing! Crazy story of my life!

I know how you feel. It seems justice is hard to find. I would suggest you get together and find solidarity with your neighbors. Some of your neighbors have to see your point! Did you every go out and try to reason with this individual and find out why he is so bitter toward you? If you have any neighbors who you are close to you, why don't you have them accompany you the next time the kid pulls this stunt? Then you will have a witness and support.

A restraining order is NOT a criminal conviction... It is simply an order out of the court.

im still a teen, and you probably wont even take my answer seriously or think it will help, but my mum went through something similar as you with my stepdad. in my opinion, if you have the baby, and he is like the way he is now, your child will not grow up happy. right now you are thinking the best of you and your husband, and what both of you need. what about your kids ? your 15 year old son and the baby that hasnt been born. im saying this from the point of view as a child, that its painful to grow up in a bad family. from the way he treats you, the best thing you could do is leave him. my mum was always soft, and in the end couldnt leave my stepddad, but i know that she lives unhappily, and my stepdad is a real jerk. my sister, who is only 5, grew up really fast because she had to witness my parents fighting. its even sad for me to watch her, so young, to be put through that. do you really want your newborn to go through witnessing his/her parents fighting? his not worth it.

I have never had an order placed on me.when it is your property,all you gotta do is get a bad dog and put a sign up saying......beware,bad dog!!! you will find it actually works for the loonies entering your property(drive way) and for the subsequent court case!

Wow, that is unbelievable what happened to you. I think you should appeal it and try to get your record clean. The judges decision was wrong. This has never happened to me!
You have no criminal background and the kid has a criminal background. I guess his mom paid for her stupid actions.
EDIT: Have you tried to bring this up to the media?
