A contractor did the plumbing work in my house. Some of it is in my living room ceiling. Some of it started to leak after we had moved in and the ceiling was up. We agreed that he would fix it by handshake. The original work was done under a contract. It's my belief that he should have to fix it anyways. He's fixed the leak, now he's repairing the ceiling he had to tear out from the leak, and he left a mess in my house because he didn't cover anything up. I confronted him about it, because I have a 5 week old baby in the house. He claims he didn't because we didn't give him the stuff to cover up the room with, and he doesn't have that stuff. I told him that was unprofessional, and he threatened not to come back and finish. He said he didn't have to finish. Is there anything I can do if he decides not to? Not to mention it's taken him 3 months to get this far.

I would threaten to get a lawyer and take him to small claims court. I hope you asked for references and such before you hired him. Does he have a valid license? You can ask for his license number and by law he has to give it to you. You can also file a claim agianst him through your insurance company. That way, the work HAS to get done. The next thing I would do is contact the BBB and complain about him. It's idiots like this that give us contractors a bad rep. Three months is way to long to get the work done.

Document everything. If your contractor is licensed by your State board, complain there first. His liscense fee covers insurance against bad work. They will inspect and if they agree that the work was not done correctly, they will ensure that it is fixed properly. There is likely no consideration for a mess made - only if there was material damaged. If your contractor is not licensed, then you only option is small claims court.

Get a written estimate from somebody else to finish the work. Take him to small claims for the amount needed to finish the work.

have you paid him the full amount? if not, you might have a chance to get him to come and finish the job.... however if you owe him nothing, then.... good luck
