I took out some credit cards 3 yrs. ago and now I owe, and creditors threatned to get stuff from my house...can they get things if they're my spouse's things not mine?

allot of these are threats and if they are threading with your spouse involved this is illegal. The previous posts listed 8 states that are community states then they could. You sound like you have a real good one here. It takes so much effort to put liens on things, they will never come by with a moving truck and clear you out. I have heard many times they threaten such action. If it is a large amount a money seek a attorney for some advice. Now if it is 1500 or under two thing.
1) offer them 1/3 of the balance
2) just change you number and gamble if they are going to sue, your chances ending up in court become much greater on balances 2k or more
whatever you do get it writ ting before paying these clowns a dime and always uses certified mail AND demand them to delete this debt.

Your creditors cant take things that were owned by your spouse prior to your marriage. That's called stealing. They can however go after your wages or other accounts for the debt that you owe. You would be best to work out a payment plan with them to stop all the harassment.

They can sue you in court and get a judgment, then they can attach bank accounts, garnish wages (if your State allows it) and file liens on any other property you may own like cars, boats, land and homes but they can not take personal items from your home.

As far as your wife is concerned unless you live in a community property State like AZ, CA, ID, LA, NV, NM, TX, WA or WI there is nothing they can do to her.
