my attorney needs my wife to provide a copy of her 1040 or 1040A form from HR block. She says they don't have it on file there cuz she did an amendment for that year and she only has the 1040X form after the amendment. Will HR block provide a 1040 or 1040A copy after dooing an amendment and if my wife doesnt have one with her? if no how can we get a 1040 or 1040A for 2006???

If H&R Block did the original tax return, they were required to provide the client with a copy of the tax return. They are not required to retain the document, only certain filing information.

If they prepared the 1040X, they may or may not still have the original tax return. Go back to the office that did the 1040 and ask if they can provide you with a copy. If that is not possible, then the IRS will provide a copy of the tax return upon request, and a fee.

Form 1040 and/or 1040A is the tax return you file, so in other words, that's what the government calls it. If you didn't file a tax return (1040/1040-A), then no you wont have one. You're not required to file a tax return unless you make over a certain amount of $, I belive it was around $5,150 for 2008, or something around there (check filing requriements on IRS website). Also, in filling out the FAFSA form, check with your parents, they may have claimed you as a dependent, and you may have to report those line items off of their tax return.

When HRBlock did your wife's orginal 2006 1040 they gave her a copy then. After starting the amended return (1040X) their software will not allow the 1040 to be printed again. Therefore if they told you they can't get you a copy, they're not lying.

The IRS might be able to provide you with the original figures.

Form 4506-T can be faxed in. 10 days turn around time.

Ask for the Record of Account since you know she's already filed a 1040X. (This way you'll get the computer version of the original return--it's quite readable--as well as the changes to the account since then.)

A 1040EZ will suffice for whatever she needs it for. If she filed a 1040EZ then there wouldn't be a 1040 or 1040A.

Depending on what it's for, the attorney might want the 1040X anyway.
