The Geneva Convention allows the indefinite incarceration of combatants that do not qualify as a POW.

Read it. One of my favorite parts concerns Law Enforcement and Punishments in an occupied country. The Conventions state that local laws should be followed. As such these guys are lucky that the US did not inflict Islamic law or field tribunals. Both of those would have resulted in execution.

Is that your preference???

Shut down Guantanamo and kill all the prisoners (who were mostly captured as enemy combatants anyways). Since terrorists kill anybody they capture we should do the same. Take no prisoners. Not even provide medical treatment to those we wound. But we are Americans and have to be civil. A head shot should do, as compared to the barbarians who chop off heads and such. We should at least be as humane with them as with dogs, even though I'd value a dogs life over that of a radical Islamic terrorist... No prisoners means no prisons, no need for trials, etc. I think we would all appreciate the saved tax money. As far as what the rest of the world thinks about us, we'll beat it out of them when we want their opinion. Until then they can all keep their mouths shut. I could care less what they think...

How about reading the Geneva conventions and it's regulations on the treatment of prisoners. These are combatants who are now POW's and afforded all rights under the conventions. Which I should note are NOT followed by the enemy who prefers to decapitate and mistreat it's prisoners. They say ignorance is bliss, after reading your question I realize that you must be ecstatic.

Because they weren't arrested, they were captured.

They are there to gain intelligence information.

Not to be tried and convicted.

That is a huge difference.

Completely agree. Time has come to convict and punish these people or release them.
