Theoretically this is highly illegal. It is called Piracy. Microsoft will come after your butt. In some states, you do jail time AND a fine. Louisiana, for example, makes it a class E felony for certain items. Now, WinXP - might be misdemeanor given the sale value of the software. But full-blown MS Office costs enough that it would qualify as that class E felony.
On the other hand, ... if you bought your computer from a reputable dealer, you should be able to ASK for them to include a WindowsXP CD with your machine. And while you might have to pay a media charge, it shouldn't be that much.

even if you get it you're gonna have a hell of a time trying to activate it. it's not worth it.
Ubuntu is amazing however i've had problems hooking up certain hardware like wireless cards.
sometimes it's better to get a new computer or live with the one you have.
