My car was hit while parked did a police report . Person claimed that she had insurance. However.when I contacted the ins company they said it has not been active since 4 mts ago. By her own admission; payments was never deducted from account; but thats not her fault claims that she is going to have to fight with insurance company to get them to pay. what do I do I have had this car a year paid 16,000 for car with this hugh dent its worth less than half and look bad

If you have collision coverage (can't imagine that you don't) have your own company pay for the repairs. If you don't have collision coverage, your only recourse is to sue the person who damaged your car.
Uninsured motorist coverage doesn't cover property damage. It covers you for bodily injury.
Sue the person who hit you if you had only liability.

You're going to have to sue her in court. But you probably still won't get any money.

Not carring collision coverage means, you're self insured. Sorry.

Underinsured motorist is a BODILY INJURY Coverage, not a parked car coverage. There's another coverage called uninsured motorist physical damage, but it's usually sold WITH collision coverage, and not available in all states.

Likely, if you don't have collision, you don't have UMPD, either.

Uninsured Motorist Coverage
Pays damages for bodily injury or death caused by an uninsured driver or hit and run driver who is legally responsible for the accident.

under Most insurance coverages. You have uninsured motorist. Call your insurance carrier and give them all the facts. And you should be covered under the uninsured motorist area it is part of your insurance and in Calif. it is mandatory.

I have liability insurance and my policy says that if someone without insurance hits me, they cover upto $3,500 for repairs.

I am sure you have atleast liability or better insurance
