No. Private creditors don't have access to this.

No! They will auction the vehicle and file a motion in court to garnish you. Sometimes you can talk to the company and make a settlement offer. Before taking anything from you they must receive a judgement either by default or by the judge granting it. Most likely they will try to take your state taxes if they go after taxes. There are many things you can do to prevent a garnishment. If in fact they receive a judgment against you. File a motion for installment payments that way your checks aren't garnished but make sure that you pay. As the person before stated. Private creditors don't have access to your federal.

No, federal refunds are only taken for back taxes, defaulted student loans, and overdue child support.

They can garnish your wages though if they get a court judgement against you.

Yes but they will have to take you to court first. They will have a deficiency judgement. They can go to court and ask what you are getting back, a judge can give them that money. First they will go for money in your bank account, or garnish your wages. Take money directly from your check.

And they will. See if you can work something out with them before it gets too bad. And stop calling it your boyfriends car, if you signed its your car too. They will go after somebody that can pay.

They will take the car and sell it at auction, normally black book. So they sell it for 4,000 when you owe 10,000. You owe them the difference, plus interest, plus recovery charges, plus attorneys fees. You might owe them in this case 8,000 dollars.

Sorry but thats what will happen. They will try and collect it.

**** UPDATE ****

Not exactly what I mean on how I guess people read this. Once we have a judgement we pull you into court. We will ask if you are getting a tax refund? you will answer under oath yes or no. We say is it an automatic deposit? you say yes. We say what bank accounts do you have? We get a Writ of Garnishment on all of them. Tax return comes into your account, it goes to the bank. thats what I meant. Clearly we cant garnish IRS. But we can still easily get it.

Just dont get automatic deposit, get a check. Dont deposit it, cash it. There clearly isnt enough time to worry about it this year. But once they have a judgement, change to a new bank. Only tell them where you bank if you are ordered too by the court. If a tax return or any amount comes into the bank with a writ of garnishment its theirs. Thats all I meant. I wont happen this year. But worry in a few months. You will have to tell them where you bank and work. Most likely they will take 25% of what you make and everything deposited in your accounts.
