I wanted to thank everyone who answered my last questions about my husband's I-485 (Adjustment of Status) and immigration interview! I do have another question, however, regarding my husband's Work Permit (I-765)...

Ok, here's the thing - my husband filed for his Work Permit (I-765) waaay back in June of this year. After about 4 months of not hearing anything, we contacted the Immigration Offices and found out that there was some sort of "hold" placed on my husband's paperwork. (Apparently, someone at the Immigration Offices forgot to lift this hold, after we had sent them the paperwork to their "Request for Initial Evidence".)

The question is: It has been *6* months since we filed for my husband's work permit, and we have not seen, nor heard *anything* about his work permit! (I, personally, have called the Immigration Offices *4* different times - but I really don't get much of answer!)

Does anyone know if there's anything we can do? My husband's work permit will expire soon! :-(

We did go in and inquire about my husband's work permit through the InfoPass a few of weeks ago. (4 weeks ago.) This is where we found out about the "hold".

However, we do not have 90 days to wait - my husband's work permit expires and January!!!

What are we to do?!?

You can make an appointment at your local USCIS office through http://infopass.uscis.gov. Regarding the EAD Card, you have to wait 90 days from the Notice Date on your I-797 for make an inquiry and the local office stopping issuing the interim EAD card a while ago. All they would do is expedite the case after they search the system to figure out what happened to your application. Good luck!

Here is what you should do:
1. Print this memorandum

2. Take your I-765 receipt and the memo and go for infopass appointment at your local USCIS office.
3. Insist that they follow the procedures outlined in the memo. Do not leave until they do what they have to do according to the memo. They have to provide you a receipt that they followed the procedures.
4. Get your EAD within a week or so after infopass.

The USCIS is required by federal regulations to issue EAD within 90 days.
