i have a 7 yr old son and his dad is not legal in the US. i have a job and never been out of one. i have raised my son all on my own [live with my parents]. im 23 yrs old now and want to move out, i get no help from the government or walfare or thing like that... everything i have is due to my hard work. i want to enforce child support on this guy but not sure if it'd be affective since he's not even supposed to be here. what can i do?
he sees my son when he feels like it only [once every 2 months] and has the nerve to give him about 40 ea time he comes over.
i'm not money hungry but i need help with my son's school supplies and clothing. is there a professional out there that can advice me?

we've been broken up for over 6 yrs and NO he's not on the birth cert... he was busy in jail when my son was born =(...
now he claims that he hates me and talks bad about me to my son when he does come over. he dislikes the fact that i moved on and have had a bf for close to 4 yrs.

HI. First off, in establishing paternity, they will take a picture of the person that is having their cheek swabbed and you can declare that it is that person.

Then, The child support office is there to get you the child support, not to deport people. They WONT get involved in that. They will ask your BF where he works, under what name, etc. He will need to provide previous W2 and check stubs, but, they will take child support directly from that.

This is VERY COMMON. There are a lot of undocumented here that have children with native born women, and, this is common occurrence here. Please contact your local child support office (in the courthouse) and inform them of the situation. They will reassure you that they want the child support so that the child doesn't have to go on state assistance. IF the bio-dad is working in a place that offers insurance, he will be required to provide insurance for the child.

*ok. In order for there to be an order of child support, he needs to be adjudicated as the father of your son. He will have 3 options: he can declare himself your son's father in front of a judge, request a paternity test, or, he can deny paternity (in which case the judge will just order him to take one anyway). Once he is found to be the father, he has to provide child support and health care (if available). Please think long and hard about this, dear. NEVER give an explanation about needing child support for your son. YOU aren't money hungry, your son is entitled to be cared for by 2 parents. IF bio-dad is talking badly about you to your son, this can cause long-term effects. Please weigh the benefits and risks of having him involved with the child. Sometimes people send their children to unsafe homes where the kids are emotionally or physically abused because they have heard that they NEED a father. Kids do better with a daddy, but, if daddy is harming the child, kids do better with a strong mom....

CHILD SUPPORT has nothing to do with the legal status of the parents!

trust me, the government would hunt his *** down for you if you went on welfare or any government aid. in fact, when you apply for those things they ask for fathers information bc if he ISNT paying his debt to the child they WILLL automatically open a case against him. TRUST ME. this was a super old post but I really hope you resolved it.

they wont deport him unless hes a nuisance. which it looks like he has been and well it also seems you and your son would be better off. welfare and food stamps is there to help you as a tax payer sweety. I hope everything worked out well. :)

You can still go after him just like you would a citizen. They can garnish wages, place liens, take away his driver's license if he has one. All that stuff. And if you go on public assistance, the state will go after him even harder to recoup the costs. The pen truly is mightier than the sword. Get on it ASAP.

You can get a free consultation with most lawyers and he or she can walk you through the steps. That's how I did it when I was young. The lawyer wrote it out for me and I did the legwork (I was 24).

***By the way, you can get a court order to stop visitation if he's saying negative things about you to your son. He will STILL have to pay child support. Unfortunately, this has become fairly commonplace.

Best bet is to call DCS, DHS or whatever your state calls it. Usually, obtaining services is fairly cheap...when you get a case worker assigned they can answer all of your questions.

Hmm. An illegal invader who impregnates a young girl, goes to jail, and then doesn't provide child support, and somehow is still on the loose... and yet you still allow him to visit you and your child?

Be that as it may, you should apply for welfare or foodstamps or housing assistance; these services are there for legal citizens to use when needed.

If you know where he is you can pursue collecting from him. Go to local authorities and start the case.

Go to welfare if you are legal.
That is what they are there for.
For honest, legit people that need help.
For the father, well, you probably can't do anything because he is illegal, but then again, you can turn him in.
I guess that won't do you any good though.

This is what you get for having a child with an illegal alien border criminal. In life decisions have consequences. When you make bad decisions bad things happen to you. Grow up and except that your life is going to be hard from now on, and no it's no ones fault but yours.
