i say that "I know somebody who knows how to kill a person in 8 hits"???? please help me, i need honest opinions.

I'd like to add i got numerous threats from this person such as: "ill mess you up"
"just you wait theres still tomarrow"
" id watch out at school today if i was you"
"have you seen Shawns muscles he could take you out in one hit"
"mariah could kick ur a** any day and that day or night might come sooner then you think"
"you might want to watch out for the kids at your school and in your classes"

I do not want to report this person unless i am actually harmed. but lets say i am, would what i said still be considered a threat? who would win the case? any input is good input.

If anything it might be considered an "implied" threat, but not a "direct" threat. I had someone tell me that she knew how to "make trouble for people" ... and she later threatened to report me to the IRS just to "make trouble." The judge told her that was a threat and she shouldn't do it again or else she'd be in BIG trouble herself!

Maybe you might try asking this question again in the "law" category and not Etiquette... you might get more "legal" answers there.

the law is if you have the means to do something (ex. holding a gun and threatening to shoot) it is assult. So, in my opinion, that is not a threat unless that "person" was standing by ready to kill them in 8 hits. Its kinda a silly threat though:0)

Generally, if a person hears or sees something and feels threatened or offended by it, they can sue and win. It's not about what you meant by it nor how you said it. What really matters in a court of law is that someone, anyone, felt threatened or offended by it and filed it in a court of law. It's not necessarily fair, but that's pretty much how it is.

It sounds threatening to me, but I think it would depend upon the situation you said it in. If it was conversational, no. However, if someone had made you mad and you were saying this, yes.
