i live in ny .my vehicle was parked when my druken neighbor decided to reverse his car into it over and over pushing it back into another car 09/02/07. he did not have enough insurance coverage to cover multicar damages, so his carrier asked 4 me 2 go through mine. i did.to date my car still is still being worked on. i have exhausted the rental given plus went over by $200+, which i had to pay out of pocket. i still have to pay my car notes and insurance 4 my car which i am not using and to make matters worse , someone hit the rental while i had it. can i sue for anything? help me, i am so upset right now.

Sounds like the other person had the minimal liability limits.

What is the reason your vehicle is still being worked on? Is there extensive damage? Is the shop having trouble locating the parts? Contact your insurance company and confirm with them the reason for the delay.
If the delay is on the shop, you may be able to get the shop to cover some of your rental expenses.

As far as filing a lawsuit against the other driver, I would advise not to. He probably doesn't have anything. He already has the minimal coverages with his insurance, so if a judgement is placed against him for additional monies, who is to say if and when you would ever collect it from him.

As far as his insurance is concerned. They cannot pay more than the policy limit. Thus the reason you have to go thru your own insurance.

In UK Your neighbours claim about his insurance would have been a nonsense. The start would be the third party would claim off you the second party and you would claim off your clown of a neighbour. This would quickly sort itself out and the claim would be wholey against your neighbour. May I suggest that you start with you own insurance company and let them take it from there. That is what you pay premiums for.In UK we have a legal service option on our insurance and I would use that. Let's face it your neighbour drunk or sober has wrought damage to at least two lots of property he should recompence you both for your loss. I have a word for this sort of persom but I think you already know it

First of all, you can always file charges down at your local court house for LITERALLY any thing you want. Or, at least you can try to. The worst they will do at the court house is say, "Get out of here, quit wasting our time and you can't sue for that."
Otherwise, you can file charges for any thing you want. You have a very good case here. I would suggest starting with your insurance company. Ask them for any advice. If they can't tell you what you can sue for or whom you can sue in this case, a professional Lawyer will be more than happy to help.

You can not sue for your insurance and car notes - that you pay regardless.

Your insurance company will go after the neighbor for any money they paid plus your deductible.
Once they get paid - they will forward your deductible to you.

Before you go and sue anyone - talk with your adjuster.
