My brother got violent with me because I didn't let him use my computer. He tried to call the cops on me, punched me, & I told him that if necessary, I'll pepper spray him. Then he threatened to twist my neck.

I never knew that protecting my property was a crime. The reason why I didn't let him use it was because he said the reason was personal-dealing with my family, if it's personal, then that means they're up to no good. So when he said the reason for wanting to use my computer was personal, I suspected he was going to do illegal online activity. He just went out the box because he's paranoid schizo who refuses to seek psychiatric help & tells everyone else they need help.

***If you were a cop who arrived on the scene, how would you handle this situation?

If its yours you can deny him the right to use it. If you are being assaulted you are also in the right to defend yourself within reason. If there were physical signs of assault on you he could be arrested at the scene. Otherwise you may have to go to a magistrate office and swear out your own warrant for assault. As far as the behavior/mental issues, if you feel he is a threat to you or himself, you should also see a magistrate about some type of involuntary commitment order. Its usually temporary (3-7 days) but can help. Other than that either one could be asked to voluntarily leave for a few hours or the night until things have cooled down.

As a former MP we developed a system called the UPWM or Unprovoked Pistol Whipping Method. If I were to arrive on that scene I would have deployed this technique with extreme precision. The situation would have been under control in seconds if I had responded to that call.

It is YOUR computer and YOU are responsible for what is on it when in your possession. You had EVERY right to know what he was going to do on it. lcmpca was quite wrong on that issue.

Regarding the other issue, if you were in your home and he attacked you, using pepper spray is within your rights.

If he was not a legal resident in your place he should have been removed.

All this information comes from a 36 veteran of the Boulder County Sheriff's department in case any one reading this is wondering where I got my info!!

I would separate you two, interrogate to find out what happened, and go from there. I can't get more specific than that. The thing is that if I were a cop, I could not just take your word for it. We are only getting your side of the story here, with no witnesses. So it is hard to say what a cop would do short of separate the two of you and investigate further.

First of all even IF the cop couldn't tell who was right, he should have known your brother was in YOUR house. He could leave at any time. I believe I would have know your brother was the one in the wrong.

If this happens again (and I hope it does not) tell the police that you did let him in as he is your brother but then he turned violent and you want him out.

A cop would probably seperate you and your brother; get your respective stories; and threaten to arrest both of you if either of you wished to press charges.

Cops hate unnecessary paperwork.

I'd arrest him for battery if you could prove he hit you. It is your prerogative whether or not to loan him your computer, but the reason he wants to use it is none of your business. It sounds like you deliberately provoked him. You both were in the wrong.

the police would arrest your brother. there are no sharing laws on the books! but there are many laws which would send him to jail. next time call them yourself!!!!!!

If I were a cop, I would probably taze him, and if necessary, I would also taze you.
