IF A CHILD IS 6 YEARS OLD, HAS BEEN WITH GRANDMOTHER SINCE BIRTH, THERE IS REASON TO BELIEVE THAT THE FATHER OF SAID CHILD WAS 13 AT TIME OF CONCEPTION. THE MOTHER WAS 18 (DAUGHTER OF SAID GRANDMOTHER). FATHER IS WILLING TO COME FORWARD IF NEEDED. WOULD WE BE ABLE TO USE THIS TO BATTLE FOR ADOPTION SO THE GRANDMOTHER CAN KEEP THE CHILD. THE MOTHER HAS NEVER PHYSICALLY, EMOTIONALLY, OR FINANICALLY BEEN THERE FOR SAID CHILD.

Here is what the Grandmother needs to do...

- Get an attorney, NOW!

- Contact CPS and see if you need to open a case file. (Wait until you speak with your attorney before you do this.)

- Get the father of the child to agree to the adoption.

- Either get the birth mother to sign off on the adoption, or get her parental rights terminated by the courts. If she really hasn't done anything for the child in 6 years it shouldn't be too hard.

- Get a home study done, complete with FBI check, so she can prove she will provide a good home.

Remember that you will get a tax credit for the adoption, so don't worry too much about the cost.

The only problem I can see is if the father wants the child. If the mother tries to make a case, she will have a hard time of things given her history with the child, not to mention the age of the father.

AT THE FATHER OF SAID CHILD WAS 13

Where i live no matter what thats classed as rape.
Anyway id say that the 6yrs with the grandmother has made a tight bond and it would be wrong to give the child to the mother who seems to only want the child for benefits.

personally if the child has lived with the grandmother and she has taken care of the child. She may have legal grounds to at first get guardinship, then that can make way for adoption, if the mother truly does not want to be part of the child's life.

I'm not for sure I would bring the father into this for your daughter could be charged with rape and boy would they love this in court and they might even take the child from you. Leave it alone and just love the child it's not important to adopt(your daughter and the father has left the child with you anyways ) also you need to understand grandparents don't have alot of rights. And if they do charge your daughter with child abuse for the father being 13 years old then she will never be allowed to be around the child do you want that.
Just be happy to be her grandmother and give her plenty of love. God bless you.

I would recommend contacting legal aid if you have a low income. They could assist you with the adoption process.
