My ex-fiance purchased a car for me which he is still making payments on...the car was in my name although he was the one making the payments. He is also listed on the contract with the car dealership but not on any of the DMV information. I have since moved out of the state. The insurance is in my name but that is the easy part. I was wondering how do I get my name off the registration. I know he is still driving the car everyday now that I am gone and the plates and everything are registered under my license. What steps do I need to take. I can't go back to the state right now to take care of it.

Well, you have to pay the car off, then you'll get the title from the leinholder, and then you can sign the title over to him.

OR, he can go to a dealer, and try to refinance the car and "buy" it from you.

Unless he refinances the car, or you pay it off, you can't take your name off of it. It's YOUR CAR.

That may be tough without the plates and documents to send back to DMV. I would send him a registered letter stating you are removing yourself from the insurance and registration of this vehicle (keep copies) If you have copies of the paperwork from the dealer, I would send a registered letter with notice that he is the owner of the car and that the insurance has been cancelled and the registration should be changed to reflect his name as well (typically you'd sign the back of the registration as part of a turn over) Explaining that he is in possession of the car and is making payments you no longer have any interest in this vehicle. But like I said I think you'll need a lot of documents to do this ... and of course check with the insurance company because if you cancel insurance and he doesn't insure it under his name you can still be considered responsible for the car. Good luck.

OK. There is a lot of underlying things missing here. First since you do not have the position of the car. How could you have the plates to the car? If he is on the loan alone then why is he not on the registration? It sounds as he was the co-signer of the car. If in fact he is the co-signer of the car and you have left him to another state and no longer have position of the car and wish to release your self of that obligation you need to write to the lender. Send a bill of sale to your ex. Send off the copy of the transfer of owner ship to the DMV. Then and only then take the insurance out of your name.

Most states have a form you can send in to release your interest in a vehicle, I wish you had mentioned your state and I could have pointed you to the right form.

But call the department of motor vehicles in the state the car is in, and explain your situation, and they will be able to advise you on what steps you need to take.

You're right, as long as it's in your name, he can ignore parking tickets and they will become your responsibility, or get the car impounded and that bill is yours too, so do something sooner rather than later.

Do cancel the insurance if you haven't already. Good luck.
