In our state (Colorado) you have up to 45 days to claim your stuff. Here is all you need to do:

If you do not know what company took the car, call the police ask for Auto Theft, when you get them tell them your unit has been repo’d. They are going to want to your name, and the address it was taken from. We have 1 hour to call in the repo, so they have that information if you do not.

Call the repo company and tell them your name, and the address it was taken from. Tell them you want to set up an appointment to claim your stuff. They will charge you a fee for cleaning out the unit. This is going to be called an administration fee. It should be 25.00 to 75.00 depending on how bad the unit was, meaning if it was filthy, you are looking at the high end, if it was not it will be 25-50.00.

When you go you will need your driver’s licenses, and the keys. If you forget one or the other, you will have to go get it, and of course bring cash, checks or credit cards are not accepted due to the fact you have been repo’d and that means you have begun your journey to being a risk.

Keep your appointment. If you are going to be late call. Some companies charge more for being late or not keeping this appointment.

When you get your things, take them, do not leave the grounds and go through them. There are companies here in Denver (Midnight Express Recovery Service) not to name any names that do not care if the driver steals, while others like me, will fire a guy quick fast and in a hurry for stealing out of a unit. If you are missing anything, go calmly back to the office and tell them what is gone. Do not lie about it, because a lot of us video tape the clean out just for that reason. If they refuse to make a report, go back out to the car you came in and call the police, make a report before you leave the property. If you leave the property and then make a report, that’s all it is, just a report. If you stay on the property and then make the report the police will go in and speak to them, who will call the driver in. As I said do not lie. You can get charges pressed on you for lying about a theft.

Stay calm and keep your attitude in check at all times. Some companies will not release property to disgruntled debtors.

As far as getting the unit back, that IS NEVER up to the repo company, if you want it back you will have to cal the lender, who will then send the repo company a release. No release no unit. Not all lenders will the the debtor have the unit back. If they think it is a high risk, they will send it off to the auction.

As a poster stated above we NEVER hold someone’s things “to mess with them”. By law we have to hold them for at least 45 days. WE WANT people to come get their stuff, to make room for more stuff. I have a 600 foot warehouse full of unclaimed stuff. I would let people have any waive any fees if they would just come and get it!!!!

Call the Authorities (Police) and file a report of the items missing. Most likely you will have to have proof. If the items total more then $500 then, the Repo Company can be arrested and indicted for theft. Call your local TV station and see if they are iterated in doing an investigation. Date Line NBC recently did a piece on a Repo company that was stealing personal items and cars as well. That company in no longer around. Actions speak louder then words.

PS: They have 30 days to give you your stuff back and can take the full 29 days if they like just to F with you.

Things like eyeglasses, medications, children's toys or car seats you can probably get back. Other things, your tool boxes, your add on stereo and the like, probably not, but you might check with your lender and see if they will allow it. Keep in mind anything added to the vehicle and bolted down in it becomes a part of it.

Colorado repossession law allows the agent, working on behalf of the lender, to pick up the vehicle where is and as is, including all property therein.

If you are behind on your payments to the point that repossession is a viable option, it's a good idea to not leave very much personal property in your vehicle.

Of course you can get everything back, including the vehicle, by paying the amount due, which would be the remaining balance on the loan and the costs of the repossession.

You are entiled to any personal property that has not become a permanate part of the car.

Meaning if you have installed a stereo, or put on expensive rims you are not getting them back.

Things you can get: Clothing, iPod, Phone charger or phone, glasses, baby car seat. or money ect.

You can contact your bank for the loaction of the car. By most state law they have to wait 15 days before they sell the car.

If anything is missing You will have to file in small claims court.

Get a hold of the company that towed it. Tell them that you have things that are inside the vehicle that you need to get.They will make an appointment for you to come to the storage area and pick them up. If the items are gone then you have to sue the tow company.

FROM PASS RESEARCH YOU CAN GO DOWN AND RETRIEVE THEM IF THEY ARE THERE AND IF NOT, THAT'S LIFE BUT I KNOW THAT IT IS NOT FAIR.

UPDATE:

YOU CAN TRY AND SUE THEM IN SMALL CLAIMS COURT BUT I WOULD BET THAT YOU WOULD NOT WIN.
