This is a good question.
I was discussing this with a friend who was facing this dilemma. We had discussed planting a tree, but what if the tree dies? Well, everything does die. It could be a big deal, or it could be a disappointment, depends on how you take it.
So what ever you do, you have to undertand that your memorial is simply metaphor attributed to his life, as you knew him. Perhaps, after grieving and years of acceptance, you have come to the realization that the ashes are not really your brother. And a tree or a garden cannot become your brother, rather a representation of his spirit and a place on earth where you can feel closer.
You can limit that to one spot or you can cast these ashes to the wind and know he is all around. You could have a plaque engraved with his name and toss it out to sea with his ashes. I think the sea is a common place for people to do this becasue it represents something that will always be there and it stretches beyond, to places where we will never go, but we can step on it's shores and walk through its constant waves.
But what ever you decide to do, nobody on Yahoo answers can answer that for you decisively. I think that you and your family should just figure out if you want a specific PLACE or if you want to set the ashes completely free. What you are doing is letting him go and coming to terms that it is out of your hands and in the hands of something greater.

That really is a beautiful idea and it's something you can all do together then he's there for u to go and sit by the tree in memory of him

x. i think that is a wonderful idea, we lost our neice nearly 8 years ago and we havent felt its time to scater her ashes, but we also not sure what to do, i will sugest this idea i think it will be a lasting memory and doing so much for our enviroment. x

It's hard, but I would set him free.
His spirit has moved on, your life must move on, I would show my acceptance of this by freeing his remains somewhere beautiful and open..
