Once the case has been closed, then you get the stuff back. It could take forever.

If it's personal stuff of no value as evidence it would probably be returned to you after the trial or the appeal time is up on the trial. If it actually becomes an item of evidence the judge can order it forfeited to the police or destroyed and you may never get it back.

A district judge will decide what the disposition will be. He/she can do what they want to with it. I have seen where local departments (sheriff's office) or ( Police Dept. ) received illegal drugs for K9 training. Most of the time it's ordered to be destroyed.

Without a court order telling them othersie, usually until the case is closed which is only after someone is convicted and serves their entire sentence.

Depends on what they took, and if it was legal or not..lol.. I know I didnt get anything back untill my case was closed and my Parole was over..

If it is a seizure it is obliviously illegal and you don't get it back they smoke it them self .
