The seller has been arrested by the Police for taking money from a number of people and not sending the respective items. They have been interviewed and bailed on four occasions. They have however not yet charged the individual as they state that the seller has refused to tell them anything, and that the Crown Prosecutor states that there is insufficient evidence at this stage. Surely if this person was going to be charged they would have been so already. All I want is my money back, and if this seller walks I will not get anything ! Does anyone have any experience in this field or indeed advice ? Thanks !

You have a CIVIL claim against the 'seller'. The Police and Prosecutor are concerned with possible CRIMINAL charges. These are separate issues. You have no better chance of recovering your money if the 'seller' is convicted than if they are never charged. Actually, you have less chance of collecting if they are in jail where they can't earn money.

how much was it?
did u pay via paypal?
have u claimed through ebay?
has this seller communicated with you?
have you requested the sellers contact information from ebay?

cant really help with the info given, u may just have to take a loss!

you should tell us his ebay user ID so everyone else knows not to buy from him

if you paid via paypal,
open a item-not recieved, dispute and after so many days- I think its 7 days, if the seller fails to respond- papal can refund you!

if you payed with paypal you can get your money back this way if not then im unsure how you will get it back if they refuse to give it
