My car loan company has called me multiple times this week saying that my bank declined the payment I made to them over the phone. My bank says it was paid and not declined and the bank manager faxed the loan company a copy of our statment and the she wrote on the cover page that the transaction was paid not declined. The company says that is not enough proof and continues to call me several times a day!! What are my rights on this?

I also forgot to mention that when I made the electronic payment on the phone I was given a confirmation number which they are also saying proves nothing.

Let me guess the company is Wells Fargo? Have the same problem with my sons loan, can also add they said he did not have enough insurance and tried to tap him for another $160 a month even though it is on mine. Write you congressman and file a dispute with him, the attorney general, and the comptroller of the currency. They said the exact same thing to him but records showed that the payment was made. Have had nothing but problems with them will never use that bank again.

How annoying. I suggest this:
Send the car loan company a letter telling them to stop calling you. Enclose yet another copy of your bank's proof that the payment was made. I imagine by now you're close to having another payment due, so I'd enclose a check for that payment (make sure you put what month that is for in the memo and use any stubs or whatever they require). I would send it certified, return receipt requested. I think they're going to have to do some investigating on THEIR end and see who transposed numbers or whatever that your loan account didn't get properly credited.

"Can you stop a debt collector from contacting you?
You can stop a debt collector from contacting you by writing a letter to the collector telling them to stop. Once the collector receives your letter, they may not contact you again except to say there will be no further contact or to notify you that the debt collector or the creditor intends to take some specific action. Please note, however, that sending such a letter to a collector does not make the debt go away if you actually owe it. You could still be sued by the debt collector or your original creditor." http://www.ftc.gov/bcp/conline/pubs/credit/fdc.shtm
