Please do not file your taxes until you have received a W-2.

Most firms will not give you a loan (that's what it is a loan) this year based on your last paycheck. Too many people didn't return to do their taxes with the same firm and failed to pay the loan back.

You've never been able to legally do that. You legally have to have the W-2 in hand before you can file. Most check stubs don't have all of the information needed to e-file and it's impossible to file a paper return without the W-2

There are procedures in place if your employer fails to provide a W-2 but you must file a missing W-2 complaint with the IRS first. The IRS also recommends that you wait until April for the W-2 before using the alternate methods as any refund due will be delayed while the IRS attempts to verify the information.

Actually, if you do not receive your Form W-2 by 1/31/07, contact your employer to inquire if and when the W-2 was mailed. If it was mailed, it may have been returned to your employer because of an incorrect or incomplete address. After contacting your employer, allow a reasonable amount of time for your employer to resend or to issue the W-2 (about 2 weeks).

If you still do not receive your W-2 by February 14th, contact the IRS for assistance at 800-829-1040. When you call, have the following information:

Employer's name, address, city, and state, including zip code.

Your name, address, city and state, including zip code, and Social Security number

Remember this:

You still must file your tax return on time even if you do not receive your Form W-2. If you do not receive the missing information in time to file, you may file you may use Form 4852, Substitute for Form W-2, Wage and Tax Statement. Attach Form 4852 to the return, estimating income and withholding taxes as accurately as possible using your last check stub or whatever will provide information you need. There may be a delay in any refund due while the information is verified.

No, and you never were. The IRS doesn't accempt returns until January, and haven't in previous years either - tax prep companies who seemed to allow this were really just giving you a very short term, high interest loan, then actually filing your return after you got your W-2.
