My Husband has been brought up on Child Support and the woman gets 884$ a month!!!! for ONE child....of which her parents actually house and feed.......I am wondering if there are any laws against a custodial parent having no job ? Or if there is anything we can do if she is jobless?

My hubby and I recently had his children's child support payment re-evaluated. Since ex doesn't work, and cannot prove that she can't work for any reason, and she didn't have to fill out a financial form-even though we had to, her income was shown as a minimum wage job-they are getting better about the laws and being fair to the non-custodial parent as well as the child.

The amount of child support goes off of your husbands income and what is the required percentage in your state. If his ex's parents are the ones who are raising the child, you need to try and get proof of that, then your husband can take his ex to court and try to get full custody. (assuming that is your goal is to get custody). He can try and get the payments lowered, if he goes that way, her not having a job and the kid living with his grandparents isn't going to help. He has to have a good reason on his end.

You can ask the court to decrease the child support payments. If the custodial parent to can afford to quit there should be no reason for an attempt to increase the payments from the custodial parents. Its called voluntarily impoverishment..

The lady can work or not as she chooses by law. It may not be fair, but there isn't anything you can do. Your husband is only paying a percentage of his income for the child. He is not providing the child's (or the mother's) complete support. Get over it.
