I have no issue paying child support what so ever. my son is 19, in College, an does not live at home. If he flunks out/in-complete his first semester, does that emancipate me?

Normally they have to be in school a certain number of hours and pass in order for you to be required to pay child support. If they are not doing this or not passing, you can go straight to the child support division of your state and talk to your representative, or contact your attorney. You shouldn't need to go to a lawyer though. In Oregon we can go straight to the child support division and handle these things. Good luck.

Talk to your lawyer. I guess it will depend on if you agreed to the custody settlement that way. However, I would have a hard time believing that you are going to be required to support a grown man who isn't dependent, and who throws away his college education by flunking out. God knows you wouldn't be if there wasn't a divorce situation, you'd be well within your rights to toss him out and let him figure it out on his own. But since you have a court order, I'd check it out with your lawyer or the judge involved.
