I've read at work and online the various laws of the EEO. I read parts about doing military service, and how it grants basically immunity to people performing military service.... but the term 'military service' sounds more like it's for people already in the military. I maybe be wrong...

Are there laws that will protect my status at my fulltime job if I choose to go from civilian to a National Guard or Reservist?

aah ok, so it does cover the TRANSITION FROM civilian to military. Confirm?

Limited protection. USERRA protects you in such a way that your civilian employer must maintain a job of the same pay and status for however long you are deployed/are in training and not penalize you in any fashion(pass you over for promotion, not give you vacation time, etc). This includes initial entry and training.

You are NOT immune,however, from losing your job if it would have been eliminated anyway during the normal course of operation. Of course, the onus is on the employer to prove that the position would have been eliminated regardless of your status. Also, USERRA does not apply to companies under 50 employees.

Once you become part of the National Guard or Reserve and are called to Active Duty, there is an act called The Uniformed Services Employment and Reemployment Rights Act (USERRA), was enacted in October 1994. It was updated in 1996 and 1998, and provides job protection and rights of reinstatement to employees who participate in the National Guard and Reserve.
