My friend and I work at Kmart... We get paid 6.25$ per hour. In the last two weeks, we both worked 102 hours total. 60 the week before last, and 42 last week. Also, we worked on thanksgiving for 12 full hours [which was the week of 60 hour work] Well... My friend got her paycheck in, and it was 430$$.. My work is SUPPOSED to pay overtime... did my friend get screwed? And also, they're supposed to pay time and a half for working holidays... Last time I posted this question people kept asking if I'm sure that we had the same hours. YES IM SURE!!...And we have the same info filled out on our W2 forms.. she is single and still lives at home, same with me. So whats the deal here? My dad does payroll for his business sometimes and said that he figures we shoulda made about 550-600 AFTER taxes are taken out if not a little more. What do you think?

Your Father is correct in his calculations.Firstly go to the payroll clerk and seek redress.If no satisfactory answer/explanation is forthcoming then seek legal redress.I take it you can both prove hours worked and payscale.Do not be put off by feable excuses from the company,try to resolve the situation amicably and if this does not occur then get legal advise.(if this is a regular "scam" operated by this company then there are others who deserve their money too,by taking a stand they will come forward and things could snowball and legal costs would most likely be covered by a national paper ! )

Something is wrong. Yes, by federal law you have to be paid overtime for hours over 40 per week. Gross should have been around $706.25 - 80 hours at regular pay, plus 22 hours at time and a half. If hers wasn't that much, and she worked the same as you, then she needs to talk to your payroll person or supervisor.

If the two of you worked the same hours and make the same rate of pay, then your gross pay should be the same, and if your W-4's were filled out the same and you live in the same municipality, then your net pays should be the same. Sounds like somebody made a mistake putting in her hours if the gross amount is different, or putting in her W-4 info. She probably didn't get ripped off or screwed, somebody just made a mistake, and they'll have to correct it.

Well... as I have been down this road, I can say the best thing to do is contact the labor board and dispute this. They will send you a form to fill out which you can tell the whole story and show the hours worked. They will get you your money! I can say this that any business has to pay you overtime for anything worked over 40 hours in one week whether or mot you get paid bi-weekly. They also have to pay you time and a half for holiday work!

If you're not eligible for time and a half over 40 hours, this is what I get:
Thanksgiving week
- 48 regular hours (48 x 6.25 = 300)
- 12 holiday hours (12 x 9.375 = 112.50)
Following week
- 42 regular hours (42 x 6.25 = 262.50)
That makes a total of $675.00 before taxes.

Your pay stub should indicate how many regular hours, overtime hours, and holiday hours you have been compensated for. It should also indicate exactly how much has been deducted for taxes and other costs.

*edit* Judy, non-full time employees don't fall under all the same rules. Many large chains hire a multitude of part time employees for exactly that reason. I'm guessing that Ashley and her friend aren't classified as "full time employees" working at a retail chain and only rarely accumulate over 40 hours in a week. More likely they average less than 30.

You got ripped off. Don't know what number it is for you but your state should have a phone number that you can call this into. I had somewhat of a similiar problem at Circuit City so I told them I quit, called the people that dealt with this and they got fined. (Thing is, they have to have a copy of the schedules by law and they couldn't prove that I was late on any of those times.)

Sorry... forgot what the person that deals with this is called. Ask your dad to get that information at his job because the state uses the same number.

You not only got ripped off, what they did was illegal.

And not true, "murrayc". Some states have different overtime laws and some types of occupations and ages it's the same thing. Think of it like the minimum wage. Different labor laws for each state.

remember when you work extra and make more you might be out in a higher tax bracket.which means they will take more out in taxes..look at your pay stub and see how much they took out add that to your bring home pay and see if it ads up to what your pay times hours..if not then i would question it...

overtime is paid after 40 hours at time and a half rate (that's the law)
if a person qualifies for holiday pay and works on that day, the get an average days' pay for the day + time and a half rate for working on that day.

Talk to your GM for sure............ wow $637 is what you should have got paid (without taxes) . . . but it should even out with over time an time an half for working thanksgiving..... yeahhhh sounds like you got shorted some.... bummer! :-/
