i went to china for 6 months vacation and i fell in love with another man there i had to come back to the US and he is in china i am wondering if we get married in america massachusetts will he get a green card if not are their any perks or any helpfull tips to get him over here? chinese arent eligible for green cards but there has to be some way pls help.Thanks

Can a gay marriage (even in a state where these are legal) be the basis for a Form I-130, Petition for Alien Relative, for purposes of immigration? For the purposes of immigration, a marriage’s validity is a question of Federal law, not of State law. In 1996, Congress clarified the Federal law concerning recognition of marriage by enacting the Defense of Marriage Act (DOMA), Pub. L. No. 104-199, 110 Stat. 2419 (1996). The DOMA contains a statutory definition of "marriage," and of the related term, "spouse." Pursuant to the DOMA, in order for a relationship to qualify as a marriage for purposes of Federal law, one partner must be a man, and the other must be a woman. This definition applies to the construction of any Act of Congress and to any Federal regulation. USCIS must, therefore, administer the Immigration and Nationality Act in light of the DOMA, and cannot recognize the validity of any same sex marriage."

Well to really fix your problem, you might want to stop going to foreign countries to fall in love or in lust with men. You have been there for only six months and already talking about marriage. What happens if you were to go to France for six months?

It is hard to get to know another American in six months. You did not fall in love for love is a choice, and you do not accidentally fall in it. You fell in lust! You might want to seek counsel as to why you gravitate toward every man you sleep with on a continuous basis. I know I sound too harsh, but sugar coating it will not help your plight.

Your problem is not marriage; you are too needy. You need a man to validate or complete you, be he Chinese or Turkish. Thank the man for giving you a good time and move on with your life. Also, keep in mind that you could have ended up in prison in China. The world is not San Francisco.

Your buddy can legally immigrate and get a eco-friendly card that way. yet, that would desire to take dissimilar time. Marrying him won't help good now because of the fact immigration is a Federal situation and the federal government would not recognize comparable intercourse marriage. I recommend he attempt to legally come right here.

Massachusetts does not "allow" or "sanctify" gay marriage unless you are a citizen of that state and continue to reside there for eternity. Once you leave its "comfy" confines your union will not be legally binding anywhere else in the USA. The state of Massachusetts does not want to be known as the Las Vegas state for gays!.

The federal government does not recognize gay marriage. So he stands no more chance of becoming a citizen then the billion or so other Chinese who would like to be US citizens.

Act as a sponsor for a man in China to come to the US as a tourist. After his arrival, marry him so that he could be eligible for a greencard as a spouse of an American citizen.
