Over the last year, animal control has visited my house in Merced, California on complaints that my dogs are barking.
A new house had been built right on the back of my 1.3 acre home. And from the first day these guys moved in they have harrassed me in person and with animal control and sheriifs about my dogs. Im at home Tues- Saturday and they dont bark anymore than is normal for a dog. If they hear a noise they bark, like the lawnmower, somebody at the door etc. Shortly, Im going to have to go to court on this. During all the visits from animal control my dogs have been quiet but they say they are only messengers and cant testify. My other neighbors and our Vet our on our side. We've put bark collars and invisable fense collars on our dogs.
The animal control guy said in the other cases that get out of hand, the judge orders the removal of the animals......even though as ive said ..our dogs are not doing anything out of the ordinary.
Any ideas?

Have your other neighbors testify for you. If they're for you then they could show the judge that there isn't really a problem. You could also videotape the dogs to show that they only bark at specific times. But your neighbors will be the best for your case.

Wow, all I can say is good luck. Everyone else's answers addressed what I feel would have been your best defense. In filming your dogs daily activities, you might actually catch the complaining neighbors agitating the dogs or at least showing you why it is that your dogs bark either at them or while they are making notice. Your neighbors will be your best defense. I can't logically imagine someone new to the neighborhood coming and changing the dynamics this way, especially if there haven't been any prior complaints.

I feel your pain. Went through something similar with my neighbors. What do they expect?? Dogs bark, it is part of the natural order of things. I cannot believe that a judge would tell you to give up your beloved family pets because you happen to live next door to a couple of uptight, anal retentive dog haters. I would suggest trying to get some video with sound, like a typical day in the life of your dogs to show the judge that they are not barking all the time. Also, have you tried to enlist the help of the ASPCA or some other group that could possible offer some assistance ? Or you could get other neighbors to sign an affidavit stating that they are not bothered at all by your dogs and that they think this particular neighbor is just doing this because of a conflict of interests. Anyway, good luck to you and keep us posted as to how court turns out.

That is really strange... in my town, if there is a complaint for dog barking and when the animal control office comes and there is no barking, they are not allowed to issue a citation. Gather up your receipts for the bark collar and invisible fence to show you are trying to correct the problem. Why can't the messengers testify? They can't even sign an affidavit?

You have my support in this really annoying situation. All I can think of is that you need to get all the back up you can for your court case. Maybe your dogs already sense what Wankers your neighbours are. I'm sorry I can't suggest anything else, but these kind of things leave me speechless. It looks like you have a fight on your hands. Most annoying neigbors are idiots (like yaguru below) and really dont care about animals. Do as others told you and video tape your dogs and ask your other neighbors to testify. I had this problem with my dog and I ended up locking him up at night in the garage but during the day I allowed him to bark his you know what off.

Best advice I can give you is to video tape or audio tape your dogs for several days at a time. It's probably best to video tape them since it's dated and can show a continuous time of them barking only for certain things.
They are dogs after all.

get a lawyer and have all these people subpoenaed unless ou can get tehm all to come forward on there own. If animal control is a payed position then yes they can testify but won't without being subpenaed
