His sentence is currently under appeal. He was convicted and sentenced to death for the 1981 murder of police officer Daniel Faulkner, and is currently a prisoner at State Correctional Institution - Greene near Waynesburg, Pennsylvania. In December 2001 a judge of the United States District Court for the Eastern District of Pennsylvania affirmed the conviction but quashed his original punishment and ordered resentencing. Both Abu-Jamal and the Commonwealth of Pennsylvania appealed. The case was orally argued before a three-judge panel in the U.S. Court of Appeals for the Third Circuit, Philadelphia on May 17, 2007, and is pending.

Since his conviction held, he will still be eligible for the death penalty, but a new jury will need to hear a sentencing phase trial and recommend either a life or death sentence, assuming the appeals court upholds the US District Court judge's ruling.

Jamal is a cop killer. The various stories you hear about other shooters is crock. The fact is the gun fired by Jamal was at his side. A bullet fired from the gun was the same bullet that killed Ofc. Faulkner. A bullet from Ofc. Faulkner's gun was found in Jamal.

He should have died there at the scene, he should now die in prison as quickly as possible.

He is accused of killing a cop. There are witnesses who have always said it was a different person. He ought to have a new trial in my opinion or be released.

I believe his sentence was commuted to life.

I would not mind at all if he were executed. His actions have "earned" it.
