I was rear ended yesterday...totally not my fault. Got a police report and everything. The kid assured me he could afford to pay out of pocket because he did not want his insurance company to find out about this. This is because he is on a "student away at school" discount where he promises that he will not drive his car when he is at school.
Well, he totaled my car while he was away at school. If he wants to pay out of pocket, fine with me.
But hypothetically speaking, if he decides he wants his insurance company to pay for this is this something that they would even pay for being that he had an agreement not to be driving when attending school?

Let me add that that car is totaled. If they officially "total" it and give me the worth then I get crap. I want to negotiate with him to get the most $ I can. I dont want his insurance company to find out either.

If he wants us to do him a favor and not notify his insurance, then they can do us a favor and give us enought $ to buy a reasonable used car. If not, I will then notift his insurance....he gets in big trouble....they prolly wont pay for it...then we would have to sue him. Im sure he does not want that.

He has 10 days to pay up before I report to the insurance company. The insurance company will only pay what the car is worth which is less then $1,000.

Since he wants to pay out of pocket, then he can pay me enough so I can buy a reasonaable car.

Okay, what the kid is probably talking about is the "resident student" discount. Basically, it stipulates that the student lives on campus and does not drive regularly to and from work/school. If he is driving somewhere else and rear-ends someone, he is covered. His insurance should not deny the claim.
BTW you'll get the Actual Cash Value of the car from the insurance company. They would give you what the car would sell for had it not been totaled.

Having the "away at school discount" means, he's listed as an operator on the policy. Yes, his insurance company will pay.

Likely, he's not going to want to go to mom & dad to get the $$ you want, and if I were mom & dad, or if they were my clients, I would advise them to NOT settle privately for a variety of reasons.

I think this is going to end up back with his insurer. They'll pay. Then they'll retroactively remove the "away at school" discount from the policy, and bill mom & dad for the extra premium.

Psssh you need to report it. Not only is he defrauding the insurance company, he's probably going to either con you or take forever scraping enough money together to help you put your car back together. I think you should go through the insurance company, if the car is indeed totalled, not only should they provide you a decent rental, but they will give you a nice check. No waiting.

Sounds like you are taking advantage of this kid. You don;t want him to contact the insurance because you want to get more than your car is worth? Why would you think you are entitled to more than the value? No moral person would do that.

Furthermore, since you do not know the exact conditions and exclusions of this individuals policy, its hard to say if the insurance company would pay out on the claim. They would investigate and make a determination and let you know the outcome.

Good that you have the police report. Now take that to your agent and make a claim with them, let them contact his insurance and get your vehicle fixed for you. End of story.

Nobody, either him or his insurance company owes you more than the value of your car. What you are doing is bordering on extortion, trying get more money out of him so you won't report to his insurance company.

TAKE THE POLICE REPORT AND GIVE IT TO YOUR INSURANCE AGENT AND LET THEM DO THE WORK FOR YOU BECAUSE THAT IS WHAT YOU ARE PAYING FOR AND IF THIS TURNS OUT BAD THEN YOU WILL JUST FILE WITH THE SMALL CLAIMS COURT, WIN THE CASE, GARNISH HIS WAGES OR WHATEVER HE MAKES AND PUT A LIEN ON HIS PERSONAL PROPERTY, MIGHT TAKE AWHILE BUT THE LIEN WILL PUT A STOP TO HIM DOING ANYTHING THAT REQUIRES A CREDIT CHECK.

You have a right to be worried. His insurance MAY not pay if he has this "agreement" with them. He probably is not covered. Hope you have all his info since you will probably need it.
