Per the website below, NO flag may fly above the U.S. flag on the same flagpole (with one U.S. Naval exception.) Other national flags may fly at the same elevation and in the same size (or smaller) as the U.S. flag, but on a separate pole.
Now, I didn't research this any further. Whether you have the RIGHT to take it down... I wouldn't think so. It's still Someone's private property, hence probable vandalism.
A few weeks ago this very thing happened here in the southwest. The guy was righteously indignant with a "rules be damned" attitude. However, it all seemed pretty contrived since there "happened to be" a television news crew on-site for this "spontaneous" patriotic act of civil disobedience. But, I never heard more.
Interesting question, though. Thanks. Rick

As an American citizen, I think it is a right of everyone who is a patriot of our country to be able to take down a Mexican flag, because no one should be flying it in the first place.

I personally think that if legal immigrants choose to live in USA,well why would you want to put a Mexican flag up?
If you wish to have a Mexican flag up,it should be next to an American one, otherwise just don't bother to go and live in USA.
I do not think you have a right to take any flag down, but I would enquire with the authorities and immigration.

it is the regulation,no longer an act of conflict...if the american flag have been flown above the Mexican flag, the pc police might accuse the owner of being racist, and be charged with a hate crime, as properly as have his company boycotted and probable burned down.

When I go to Ensenada Mexico I always see a U.S. flag flying by some houses. What is the problem on one sweats them. Stop the racism it's just two flags flying together.

call the police or immigrations. ask them. if they say no, then i would look into suing someone over this, it is against the united states laws to fly another flag unless flown with united states flag on top. tell them you find it offensive.

Accroding to US customs, rules say that no flag should fly above the flag of the United States. The US flag should always be above and if their are several flags then the US flag should be furthest to the right.
However, you should not go take this down since it is not respectful of other cultures and since we are allowed freedom in the US we have accepted the flying of other flags. YOu are allowed to be somewhat upset though and you can say something to the flag owners

how come you complain about the Mexican flag flying about the US flag and no one as i have ever heard on here complains if they see some Swastika above one is it because you know the nazi loving militia's would come out with machine guns if you tried to take it down.

Flying the US flag on top is a custom and sign of respect, but not a law.
If you take someone else's down on private property, that is trespassing, vandalism and maybe theft or destruction of property.
