Okay, so in Illinois, if you are at a party that gets busted, and you're high (on weed) but have no paraphanelia or marijuana on you, and aren't OBVIOUSLY high, can you get arrested or cited anyway?

If they perform a drug test (as in a sweat-test with the swipe of a cotton swab) on you, and THC is shown to be in your system, yes.
If they don't smell it on you, and you're not acting impaired, and you don't have anything on you, they can't do anything that will hold up in court.

i don't know about Illinois but i do know that you can get arrested for being under the influence of drugs or alcohol if you are acting in an obscene way. i don't know that weed makes you act like you would per say on alcohol but to my knowledge you cant get arrested for anything without probable cause. or searched at that matter.

yes, for being under the influence (especially underage) or public intoxication. If you are OBVIOUSLY high, then you keep your mouth shut or quietly walk away. It is those who think they know it all and argue with the "law" that get themselves thrown in the slammer!

Cops are punks!If your a nobody and don't have the cash for a lawyer, they can do what the hell they want.You might not get prosecuted at the end but they can screw your day up by throwing you in jail for a day.
