i am going to court for the first time and i need help whats going to happen in court ok i got in a car accident i was driving with insurance but my name wasnt on there only my dad and my mom and i found out the girl that hit my car she didnt even have insurance or a driver license so i wanted to know what is going to happen i told people about this they say nothing goin to happen because one thing is that i dont have a job no money i have nothing and i have my dad lawer that is going with me to court she try sue my dad but the case was dismiss because she was sueing the wrong party

no i did not get a ticket the only thing that the police did was just put it down on the police report because she got her car towed for not having insurance and a ticket for no driver license all i got was the police card with the report number on there

What does the insurance company say? The car should be insured, not the driver.

Think the case will be dismissed again. Even if you didn't have insurance, she was the one who hit you. I don't get it.

Sounds like she's going for the "easy" buck. Besides no insurance, she didn't even have a drivers license. Or did she have a drivers license, but left it at home?

Either way, she was at fault. Although, with insurance companies you're still partly responsible, because you happen to be there, at least in Wisconsin. However, that's getting off the subject.

She most likely is doing this, because she wants to get some amount of money to get her car fixed, but instead she'll pocket the money. Either that, or she staged it.

Just can't see where she thinks she's in the right for any of this.

Be glad your dad's a lawyer.

Well IF you are NOT specifically named on the family auto policy then you are driving WITHOUT insurance.

Did the police give you a ticket for NOT having insurance? If so, YOU have a problem.

Did the reporting officer give you a ticket for being at fault in the accident, either driving too fast for conditions, following too close, operating a vehicle with defective brakes/steering ect? If SO, you are in violation of the state law requiring you to have proof of financial responsibility (insurance) when operating a vehicle on the road.

If you were NOT given a ticket for wrong doing and the other party WAS given a ticket (someone was given a ticket else you wouldn't be going to court) then you just dodged a "financial responsibility" arrow and your only reason to be in court is to testify against the other party as to what damages she did and how you have not been reimbursed for them yet. (her people are supposed to get in touch with your people)

As to your have no job and no money and you think you will skate in court because of this fact, SURPRISE! SURPRISE! SURPRISE!, the judge is JUST waiting for some yuk like you to make that their defense. If you have any charges brought against you and you use the "can't get blood out of a turnip" defense, your gonna wish you WAS a turnip when the judge gets done with you.

You see, the judge just LOVES fresh young (meaning stupid) meat like you. Because you are easily impressionable, they will make an example out of you in hopes of setting you on the straight and narrow.

Suppose you were to have run over someone with the car and hurt them REAL bad and used the "no yob, no mon, no comprehendee your honor" as a defense. Do you STILL think that NOTHING will happen to you because daddy warbucks and his lithsome, leggy lawyer is in court with you. Not on your life.

You can expect to get a fine of up to $600 for the driving without insurance ticket (if you got one) and be liable (meaning the judge could give the other party damages if they find it was your fault) for the repair of her car.

The fact that SHE too was without insurance AND a license COULD be argued that you are estopped from being responsible for her damages in all but the most egregious of situations.

Sounds like no one even THOUGHT to call a cop on this issue.

Good thing your dad has a lawyer to represent you. Since your parents are listed on the insurance policy and if they do have you as an optional driver, then you are covered. If you are not listed as an optional driver than you are not covered.
Since this female has no D.L. and insurance, (hopefully she has a job) then you can sue her for damages. Provided she is at fault.
If you are at fault and you are a minor, your parents are responsible for your bills. Which they will make you work off till its paid. No allowance for the rest of your days!
If the prosecuter/judge is like the one her in the town I am in (the twilight zone) she would have fines, fees and (if she cannot pay) jail time.
I would see if you can get her to reveal (under oath) where she lives, if you two did not exchange addresses and where she works. What financial means has she got. If you wait till later it is hard as hell to track them down.

Dress appropriately... which means with respect for the court. Not necessarily a coat and tie, but something nice as you want the judge to see that you respect the court.

Insurance isn't an issue other than it is illegal not to have it. Otherwise, it is all about who is at fault. If someone has to pay, it either comes out of their pocket or their insurance picks it up. Saying you don't have any money isn't a concern of the court as they only decide who is at fault and who owes who for what.

IOW, if you rob someone that is a disgusting person that everyone should hate, it makes no difference, you are guilty.

Be sure to dress respectfully such as you were going to meet God. Dark colors are good nothing trendy, loud, baggy, etc. Next when and if you are asked a question answer in a tone that is respectful and loud enough to hear without being asked to repeat answers, also look straight at the judge without looking around or down, this shows you are not trying to hide anything or make anything up.
Just tell the truth make sure you have all your papers in order and have not forgotten anything and good luck.

You'll shoudl be fine, she has no drivers lisence, for all the court knows, she can't drive and should have went to jail, and got a ticket for no insurance. She trying to go for a free ride, counter sue the witch.

If the girl hit YOU, why would she sue you? It's her fault. Your parents technically are liable for anything that happens in their car, but fault has to be put on the one who caused the problem. Talk to a lawyer and find out what is what.

You were driving without insurance. If you are not on your parents policy and you have no policy, that means YOU have no insurance. Who's at fault does not matter to this judge he only needs to decide if you were uninsured. Most jurisdictions have a set fine for driving w/out insurance plus court costs. It is people like you driving uninsured that makes honest people who have insurance policies pay more. Shame on you and shame on your parents. Thank Goodness no one was hurt.
