O.k well he came here when he was a baby his parents brought him here he whent to school he speaks good english etc.... he has a good background. I am not a citizen but can become one in 2008 I am a recident here in CA we have a baby he was born here I am sooo tire of him getting fired for not having a good social# can any one idvice me on what to do a good lawyer how long will this proces take after we get married????

people cant you read I have a resident card I will become a citizen 2008 I am not Illegal you. And he did not brake no law hes parent brought him here is not his foult he dosnot know anything about his country Some of you people are just stupid and need to grow up.

I believe that I am more than qualified to answer your question than most of these people in here that have already answered.

1. You need to wait until you have become a US Citizen Next year. You need to apply for Citizenship about 4 to 6 months before your Residential runs out. (Go to a Lawyer for this. It is much quicker then doing it yourself.)

2. How old is your BF? If he is under the age of 17 then he can still stay here with out going back to his Native Country, and if His parents are of some kind of Legal status then he can get his Residential Alien from his parents.

If Not and he is over the age of 17 he will be require to go back to his country and ONCE YOU HAVE BECOME A US CITIZIN then you will have to petition for marriage for him to come up here. Then he will recieve a temporary Visa. Once he receives his temporary Visa then the two of you can get married.

However, You really need to get a good Lawyer for this. Keep in mind that this will cost money alot of money. Because he came here illegally and he has to pay the governement a total of somewhere around $1,500 on up for being here illegal, not to mention the lawyer's fee will be some where $1,500 up to around $2,500 depending where in CA you live.

Also, If you truely love him and want him to become legal then do not get married first before doing what I have stated above, because if you then he will not be able to come a Resident and become more complated and take more years and cost more money.

The best thing you can do is to talk with an immigration attorney. Look for someone who is a member of the American Immigration Lawyers Association (AILA). If your boyfriend has been here since he was a baby, there may be something about his parents or his past that might allow him to get his green card in the US. If he's not eligible to adjust status in the US, he'll have to go home to get his papers straight and he probably faces a 10-year ban on coming back to the US. Definitely something you want to talk over with an expert before doing anything.

If your boyfriend is eligible to adjust status in the US, you will have to wait to file papers for him until you are married. A visa will not be immediately available for him (visas for spouses of permanent residents - F2A - are backed up about 4-5 years). Once you become a citizen, you can notify the government and they will update your husband from F2A to immediate relative - IR - and he can apply right away. The process usually takes 8 months or so from the time you file, not counting the wait for a visa.

You need to get your citizenship first. Once you get that, you can petition for him. You file the I130 which will more than likely be approved. Then you file the I485 which will be denied because of the illegal entry.

You will file the I601 and he'll have to go home to his home country for an interview and you, as the US Citizen, will have to prove that without your husband, you experience extreme hardship. You'll have to write a hardship letter.

The time after his 18th birthday will count against him so if he hasn't been here 6 months past his 18th birthday, the best thing might be to have him go back home, wait for you to be a citizen and then do a fiance petition. I'm not exactly sure if that would be better than him staying and going the I601 route but the people at http://immigrate2us.net will be able to answer you. Many people have gone through the process to legalize their spouses who entered illegally.

#1. You're a legal resident.
#2. You have an illegal boyfriend. and a baby with him.
#3. You realize that just because the baby is born here doesn't mean that both of you have to stay here, you can go back to your countries and raise that baby.
#4. He has been committing fraud by using bad social security numbers, that's a crime.
#5. Just because you marry him won't change his immigration status or yours. You'll still only be a permanent resident married to an illegal, with an anchor baby born to keep you here.

You made some bad choices already. Having a baby out of wedlock, and the father is an illegal alien. Not very smart. Of course your anchor baby will make it harder for you to be deported, but your boyfriend will eventually be caught and then deported. What will you do then?

It doesn't matter if you get marry anymore...
What you have to do if talk to a lawyer first.... you said he has been here since he was a baby, so it was not his decision to be here in the first place... Just contact a lawyer and then just hope for everything to get better

You had a baby before marriage and to someone in the country illegally ? Are you out of your mind ? This guy will never have to pay child support nor hold steady employment. Best you can do is let him baby sit since you will be supporting him now

If they keep firing him because he has bad social security numbers then it means he is making them up and somewhere along the line he might be using an actual persons Social number. That illegal also. Sooner or later you won't have to worry because he will be deported for illegally using social numbers. I don't feel sorry for you or him. He is illegal and I can't feel sorry for someone who isn't legal. There are to many people who do things the legal way.

As stated many times, best chance, is not to already be here illegally. You will need an attorney, if hes not going back to home country first. Please don't have kids until you get this sorted out. There are enough kids already in the US suffering because their parents didn't use good judgement.
