So, after watching the news and hearing about the Omaha incident, I wonder... if there was a person in the mall, at the time of the shooting, with a concealed weapon permit, carrying a gun, would he be allowed to use his gun to take the crazed killer down?
It only seems logical to me, that if you have a gun (and have a concealed weapon permit), and someone is shooting innocent people, you would become a hero for taking that person down using your own gun. But in reality, it seems more like you would get in trouble.

I know it varies from state to state, but what is the 'general consensus'?

The consensus is, if so many people want to carry guns, and take down killers, join the Police department, and see what it's really like. Most people would run the other way.

He has stated his support for gun control, but no laws have been enacted. We actually have volumes of laws regarding firearms already on the books, only most are never enforced. He hasn't touched the issue because he doesn't want to lose any independents that support gun rights.

If you were in a position to run away from the deranged psycho killer instead of confronting him I think you would find yourself in potential legal trouble. You can only blast the sucker if it's your only option to save yourself or your family. In reality, you may go to trial and no jury in the world will convict you of capping the bad guy. But if you get off on the criminal rap the family of the scummer could sue you in civil court because the burdon of proof is less in that court.

Yes, you are in a position to defend others in a life threatening situation.
No DA would charge you in a case like this as long as you stayed within the bounds of the laws for having a concealed weapon.

Why do you seem to be so concerned that this person have a concealed carry permit? The constitution gives every citizen the right to carry a firearm. I would have blown the idiot away and not thought twice about it.

Someone with a concealed weapon could have prevented many crimes.
And even if you get in trouble, there is an old saying:
It is better to be judged by twelve than be carried by six.

Assuming the concealed weapon permit is legal and current, and assuming that there is an imminent threat to life and limb by the shooter, take aim, fire and kill the bastard.

Jury of your peers...

I doubt any prosecutor would file a case and even a bone-head defense lawyer could get you off. Then no jury would find you guilty.

Not that you'd have to worry what with all the fan mail, TV appearances...

Absolutely. There will be an investigation, but a conviction of the good guy would be hard to obtain

If found guilty, that person would become an instant celebrity and have a TV show like the Dog
