Ok here's the details, please help:
I live in Arizona, USA and I got a ticket on 9/02/2007 in New Mexico, USA for speeding. You have 30 days to pay your ticket so I paid the ticket on 9/27/2007. Yesterday I recieved a letter in the mail from the Arizona MVD stating that they suspended my license for "Failure to comply to a traffic citation". I called the MVD in New Mexico and they said that the citation had been satisfied and my license was suspended in error, so they faxed a letter to Arizona stating that it was suspended in error and to remove the suspension. I called the MVD in Arizona to make sure it was taken care of and they said it will take at least 48 hours for it to happen. If I drive and get pulled over I will be in alot of trouble. How am I suposed to get to work and do the things I need to do without driving? I am also trying to get into the Police department and I won't be eligable if I have a suspension on my license within the last 3 years. How does this affect me?

Can I file a lawsuit against the MVD or is there really nothing I can do about it? Is this going to affect me getting into the Police Department?

Ok,let me clear one thing up. I didn't send the check in on 9/27/2007, it cleared my bank on 9/27/2007. So it was paid before it was due.

Chris W. You can't tell me you've never driven 10 miles over the speed limit!. I was going 45 mph in a 35mph.

Are you people even reading the details? I have a letter from the New Mexico MVD stating that my ticket was PAID on 9/27/2007, the letter also states that this suspension was made in error. The ticket had to be paid within 30 days of recieving the ticket, 30 days would have been 10/02/2007, It was PAID on 9/27/2007!!!!!!!!!!!!!!!!!!!! The only reason I thought I might be able to sue was lost wages, but I don't even think it would be worth the hassle. I am just mad that the MVD is so retarted!!

First, since this was handled by mail and mail takes time it is likely the suspension was NOT in error, they just decided to be nice and clear it as you mailed it before it was due. 9/27/2007 was a Thursday. if you put it in to the mail that day it probably did not go out until Friday, 9/28. It was due Tuesday 10/2/2007. if it was not received by that date they had every right to issue a suspension. You can't sue them for that (well I suppose you could sue, but you won't win). If they reversed the suspension (as opposed to lifting it) then it should not show as a suspension on your record. After the suspension is removed, go down and get a copy of your driving abstract.

As MVD has indicated to Arizona the suspension was in error I don't know what you would sue them for. They made a mistake, however it was corrected. You might have a case against Arizona if they fail to correct, however they have not yet as they indicate it takes 48 hours.
Again, if it is removed as an error, it should not affect your police application.

I have had a similar problem. If you drive while suspended, you will be subject to all problems that go with it. If you go to court, the only way out of that is if the DMV backdates your restoration. IF they restore it the same day, you were suspened, and thus cant drive no matter what. ALSO, i do not think you can file suit, becuase driving is a granted privlege, not a right.

somebody would have used your advice while they have been stopped. touch the dept that issued the citaitons, and notice in the event that they took fingerprints, took a mug shot, or had the guy sign for the tickets. it somewhat is probable somebody you're, or have been, on the brink of.... they might ought to understand your call and date of delivery. The drivers license extensive form and something of the advice may well be accessible over the pc.

no you can't sue. it hasn't cost you anything yet, so what would you sue for. there has to be a loss of some sort. second, go by the d.m.v. and get them to give you a letter stating that it shouldn't have been suspended and is being reinstated. or, if you drive don't get stopped.

I really don't know. My license was suspended for 3 yrs. & I didn't know until I went to renew it.This young boy had hit me from behind,resulting in me having cervical spine surgery.I had full coverage,but some how he sent a paper into the state capitol saying I didn't.You would think they would check these things out better,but they don't.Only thing I know to do is get in touch w/ DMV.Which you did. Just be calm when driving where you have to go.I;m sure it will all get worked out.Good luck,& don't get pulled over or caught in a roadblock.

You're blaming other people for your mistakes. You waited too long, and didn't take into account processing time. You're lucky you don't have to pay a reinstatement fee. In fact, i suggest that you check into that. If you're stopped before it's reinstated, you're guilty of driving on a suspended license.

#1 if you don't break laws, you won't get pulled over.
#2 once AZ gets the letter from NM it shouldn't be listed as a suspension. It is like when you get a speeding ticket and then take a class to get it removed. it is on your record until you complete the course.
