Hi, Charlie. 'Notwithstanding anything contrary' is a legal phrase that is quite necessary to enter into the contract in the interest of both the parties that enter into the contract. Our democratic government is guided by 'Rule of Law' through which the rights of a citizen are granted and guaranteed. This phrase clearly guarantees that the contractor would be benefitted by the payment of the actual costs he or she incurred in the process of his or her commitment even other requisites may prove contrary to some of the provisions of the contract. This explanation is given on the basis of the limited explanation given by you.
