Because if the husband gets arrested, then gets out of jail, who is to prevent him from coming home? After all, it is his address too. I'm just not sure how that all works.

Normally there is a "Condition of Bond" which restricts the offender from returning to the residence. If same violates that order...it's right back to jail without bond!

The wife should get a protection order (some times called a restraining order, TRO, TPO etc). In some cases it may be automatic and others it may require that the wife go to the police station or court house and file for one. If you are in this situation, the DA's office should be able to point you in the right direction.

That's why you divorce, move, and get an restraining order. If you send your husband to jail for rape then why are you going to stay with him?

why would the wife want him back home? The wife can get an injunction.

There is no such thing as spousal rape? Why didn't you just give it up, everything would have been fine.
