My buddy just got charged with Malcious wounding, I live in Virginia. What kinda of penalty does that count as (how many years, im guessings its a felonY)
So the story goes there was a fight and my buddys friend was shot with the guy they were fighting with and died, the cops say the beat the **** outta the guy and thats why hes got malicious wounding, also they are giving him grand larceny for having the dude who got killeds phone. Im worried about my friend. what is gonna happen?

the guy who fired the gun is getting off for self protection and he had his gun registered and a concealed weapons license, but it was on his property and none of my friends were armed

Malicious wounding is a serious felony charge with considerable penalties and jail time if you are convicted.

Malicious wounding as defined by the VA criminal code is the act of shooting, stabbing, cutting, wounding, or causing bodily injury with the intention to maim, injure, disfigure, disable, or kill.

Under Virginia criminal code, Malicious Wounding is a Class 3 felony, which carries with in penalties of up to 20 years in prison.

To prove a charge of malicious wounding, the prosecutor must establish intent and malice. If, not the charges should be reduced to unlawful wounding. Depending on the degree of injuries sustained, it may also be possible to get the charges reduced to a misdemeanor assault and battery charge.
