would my insurance pay it, assuming its his fault (I live in MA with full coverage), and I was in the car?

Depends on how the policy is worded, if there is a cancellation clause if someone other than yourself or someone who is not listed as a driver of the vehicle, they may not have to cover it.

Usually they will start with the insurance of the person that was driving and work downwards to the vehicle owner's insurance. Each insurance company will then determine a certain percentage of who was at fault.

I live in MA also, and I would call your insurance co. to report the accident I believe in MA you only have 48 hours to report an accident or you get a fine or a surcharge (something like that!) You may get a surcharge on your insurance anyway as well as the driver.

I would think that your insurance would cover it, since you have full coverage because full coverage covers anyone who is in the car. But im not sure about the laws there.

Does your insurance policy cover you if another person is driving the car? You have to check your policy to be sure.

CHECK WITH YOUR INSURANCE COMPANY BECAUSE IN MOST STATES YOUR FRIEND WOULD HAVE HAD TO BE ON THE POLICY AS A NAMED DRIVER.
