I just moved here to texas from California, and it's very frustrating to me that everytime anyone here has even the slightest fender bender, they leave their car parked in the middle of the road, blocking up traffic, and creating a safety hazard for many more people.

Is it Texas law that you have to leave your vehicle in the middle of the road if you have an accident? I would think it more prudent to get it off the road into a parking lot where you can exchange information, and not have to worry about getting hit again....

You are exactly right. It's the law if you can drive it you must get out of the road. The next step is to exchange information. The policy my dept. goes by is that if everyone has a license and insurance, the cars can be driven out of the road and no person goes to the hospital that the police will not do a report.

People (everywhere) commonly leave their cars in the middle of the road when they have an accident. It is a mixed bag. If the area has heavy traffic and poses a risk to the safety of others to leave the cars in the road I prefer for people to move the cars. A fender bender is not worth dieing over after all. If there is not danger then it is always good to leave the cars where the are until the Police arrive.

There is no law in my state (NC) that states the cars must be left in the road. I believe TX is probably the same.

I live in San Antonio and witnessed an accident a few years back. The first thing I did after making sure everyone was all right was to get the one car that was still in the street out of the way so traffic could pass -- it was bad enough on normal days.

When the cops showed up, they didn't say anything to either me or the lady whose car was moved...so I'd have to say that it's not required to leave the car in the accident area.

I was in an accident years ago and we both moved our vehicles off the road to clear the street. The officer that came to the scene said we should have left our cars where the accident happened so he could get a better idea of what happened. It was the other guys fault and the cop knew it but when the guy decided to fight the ticket... the judge was on his side because neither the cop or I had "accurate" proof of how the accident occured. That was with other witnesses too.

In Texas you purely get a quotation in case you broke between the site visitors regulations. it continuously says on the quotation what site visitors regulation you broke. The officer might have defined the rationalization in the back of the quotation on your husband while he wrote it. Take the quotation right down to the police station and ask somebody to describe it to you.
