Assuming this is someone being named as a 3rd party in a divorce petition (ie the person a spouse committed adultery with)....Unsure how North American and UK rules differ, but in the UK, you can be cited, but can refuse to sign the papers, thus refusing to admit responsibility.

It's really more of a paper exercise most of the time when an injured spouse wants their lb of flesh. In theory they can use this to make a financial claim on the 3rd party, but in practice this is hardly ever successful.

Once you get summons from a solicitor regarding divorce papers - if you don't like getting a divorce, you can refuse to sign it. But if you agree to the divorce, then sign it. Unless it's just a notice of hearings - then you have to sign the receipt copy signifying that you received the notice/ letter BUT BE SURE to read it first before signing it.

I am sure that you can divorce him after 5 years for abandonment, without his consent. In the UK divorcing after a two year separation is completely painless. You simply need a better Lawyer.
