What you're describing is statutory rape, and it can be charged as either a felony or misdemeanor in California. A crime that can be charged as either a felony or misdemeanor in California is called "a wobbler".

The only exception would be if the 17 and 22 year old were married, or if the 17 year old was legally emancipated.

Only if the 22 yo wants to go to jail...this is the rule in CA under 18 illegal...they had it o some billboards once in an area heavily populated with hispanics..seems they are more likely to be pedophiles.

No, they can't.

The age of consent in CA is 18.

Below is a chart that shows the age of consent for all States.

In absolute legal terms, yes, it probably is illegal.

In practical terms, if both parties are consential nobody will brings it up in a court of law, or provide evidence in writing to law enforcement agency.

Besides, the police have bigger fish to fry than this. They don't prosecute EVERY pair of teenagers they find having sex in a car on prom night.
