i currently got a new job as a server at a fancy restaraunt that does banquets and all sorts of parties. we get a certain percent of the service charge on the bill at the end of the party as our tip. i did a party of fifty people and me and the other girl each got an 80.00 tip. the next night i did a party of 200 people and i did not get anything yet. the employer said we dont get paid until the party pays and they have 30 days to pay their bill. is this legal? i am getting paid only 2.63 an hour and went home empty handed after doing a huge party . are they allowed to hold my pay or what?

No, it isn't quite legal. You must be paid the legal minimum wage ($5.15/hr) for EACH PAY PERIOD, regardless of whether or not the party has paid their bill. That CAN be deducted from your tips. I suggest you take your pay stubs to the board of wages & hours.
