alright my dad is getting sued because the person he rented our other house to is moving to California to take care of her dieing father in law. she wnt her deposit back which was $2000. She came today nd said ur getting sued. Can she do this. will it hold in court. She hasnt even visited her dieing father in law though so thts just weird. Legally can she win this?

it was a 12 month lease nd she randomly canclled it... it was monthy payments, i think they did complete the lease, thy signed all the papers and what not

your settlement has been offered through panic, to have made this offer they obviously know they have done wrong. However do not spite yourself , if you do not accept, this offer can be reduced and even if you take it to court and was sucessful, you could still not get this much money. But is the money important for you and your family? will it provide a better life? Please note medical negligence rates are not all that sucessful, I am a Law student and know alot about this. However from what info you have given it seems you have a very strong case as it does not seem the hospital could come up with another cause for what has happened, which is what they will try and do in defence. Generally the more possible cause the less chance of sucess, this doesn't appear to be much of a problem. Good Luck!

Yep...she is just trying to blow smoke up your a**. Anyone can sue anyone for anything....now whether they will win is another thing. If she is breaking her lease or contract on the rent house...then your father has a right to hold the deposit until she meets her requirement. He can also take out any cost of repairs that are done...that are not caused by normal wear and tear...but abuse or vandalism.

It would be hard to say without knowing the stipulations of the lease. Most good leases say right in them what happens to the security deposit. If it doesn't then the court will have to decide what happens to it. What is his reasons for not wanting to give it back?

she probably won't get a thing but other things to consider is how much is your attorney going to cost you, for one thing. If too much, you may be better off writing up a bill for a month rent for not giving you notice, a cleaning fee, cost of advertising to get a new tenant, and then see what is left and offer her just what is would cost you to denfend yourself against this and she may settle for that instead and save you all the legl problems. You may be better off offering her a couple of hundred to settle if it is going to cost too much for an attorney because if she had money you could counter sue but you probably wouldn't get anything either. If she should happen to agree though make sure that it is all in writing.

No, besides a lawyer will cost her more than the $2K. Sh might be able to take it to small claims court but they would find in favor of your father. She's just trying to scare you.
