Can anyone give me information about what a real estate's agent's responsibilities are when the owners of the house have moved to another state, and agent is essentially trying to sell a vacated house? For instance, if the empty house is vandalized several times, does the real estate agent have any legal responsibility, for instance, if she was slow to alert the owners or some such thing? Can anyone give me some sites to look up about owners (sellers) and real estate agents when the owners have moved to another location?

Thanks very much to everyone who has answered so far. I guess we need to go through a property management company to rent our house, since we have moved and cannot do things for ourselves. Any further advice is appreciated.

I agree the job of the realtor is to sell your home at the desired price. It is the job of the seller to ensure that the home is properly insured for vacant property, that utilities are turned on to prevent pipes freezing etc....

Dont get me wrong it also doesn't mean that the agent just puts a for sale sign in front of the home and never goes to check on it etc... Most sellers know if there home is located in a high crime area where vandalism is likely to happen and therefore should take the proper precautions.

The only job the real estate agent has is to procure a buyer for the property. If there is vandalism occurring, it's not the real estate agent's responsibility. You need to hire security for the property.

The fact that you have moved to a distant location doesn't change the fact that you are still responsible for the care of your property.

I don't have links for you, but... A realtor is responsible for SHOWING the property and smoothing out the transfer process... They are NOT responsible for care taking the property. That is solely the owner's responsibility, or the owner may hire a property management firm. A realtor would have no cause to be driving by the property or entering the property EXCEPT when showing to a prospective buyer... so WHY would they be responsible in any way for vandalism? I would call the owner when I got back to the office and let them know if they didn't already... that's about it...

Unless you have a contract with a Real Estate agent to monitor/take care of your house, I don't see how they could be responsible for anything. Their only contract with you may be to sell your house, not care for it.
