Car number 1 parks on a local street, aginst the curb. Car number 2 parks in front car number 1 aginst the curb. Car number 2 hits car number 1.

As it turns out, car number 1 was illegally parked 3 feet away from the curb. Although, car 2 was in fact the car who caused the crash while having full awarness of where car 1 was.

Which car deserves the punishment?

Both can be found to be contributing units. However, parking illegally does not absolve the other driver from responsibility.

When looking at who could have most avoided the accident, Car 2 is clearly at fault.

Depends on what state you live in, some states have no-fault insurance, so no matter who is at fault thier individual insurance will cover it, although car #2 should have been cited for inattentive driving, careless driving, or failure to maintain control of a vehicle, but then again after re-reading your question I see that Car 2 had to be backing up as he was in front of car#1 so driver 2 should be cited for improper backing if they both parked facing the same direction, and driver #1 should have recieved a citation for illegal parking. would need more details to be totally sure, but this was a good brain teaser, also in your "which car deserves the punishment?" question, neither car deserves to be punished it was the drivers fault.

Both. Car Number 1 for illegal parking. Car Number 2 for not looking where it was going.

The car who bumped another car is liable through the principle of last clear chance. The incident could have been avoided if the latter car observed due diligence even when the other car was parked erroneously.

Car #2 is liable. It doesn't matter if car #1 is triple parked on top of a fire hydrant in a handicap zone, it is never legal to cause damage to his car.
